Privacy Policy - Terms and Conditions of use

By agreeing to these rules, you warrant that you will not post any messages that are overtly obscene, vulgar, threatening, or that violate the law.

The Administrators of Vivamalta.net reserve the right to remove, edit, move or close any thread for any reason.

Please note that the term "Website" refers to http://www.vivamalta.net/, including all the pages accessible through this Forum.

Acceptable Use

You agree to abide by all applicable laws, regulations and codes of conduct and ensure that any content uploaded or distributed or stored by you does not infringe the rights of others.

You may not do any of the following without prior written permission from us:
  • Redistribute any of the content (including using it as part of any library, archive or similar service);
  • Remove the copyright or trade mark notice(s) from any copies of content made in accordance with these Terms and Conditions;
In accessing the Website you agree not to:
  • Impersonate another person or use a false name or a name you are unauthorised to use or create a false identity or E-Mail address or try to mislead others as to the identity or origin of any communications;
  • Modify, access or make available data stored on a computer device which you have accessed through our network;
  • Make available or upload files that contain software or other material, data or information not owned or licensed to you or collect information about others (e.g. names/addresses) without their prior consent;
  • Damage, interfere with or disrupt access to the Websites or do anything which may interrupt or impair their functionality;
  • Publish, post, distribute, disseminate or otherwise transmit defamatory, offensive, infringing, obscene, pornographic, indecent or other unlawful or objectionable material or information;
  • Threaten, harass, stalk, abuse, disrupt or otherwise violate the rights (including rights of privacy and publicity) of others;
  • Make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, 'trojan horses', 'worms' or any other harmful software;
  • Set up links to other sites, without our express written permission
We retain the right to prevent you from accessing the Website, without prejudice to any of our rights, where we in our sole discretion consider that you are contravening our Acceptable Use Policy or any other term or condition of these Terms and Conditions.

Registration

The Website requires that you register in order to post replies on the Forum and you are obliged to provide accurate and complete registration information. It is your responsibility to update and maintain any changes to that information (including your E-Mail address) by altering your details as appropriate.

Registration is for a single user only. On registration, where required you must choose a user name and password. We do not allow any of the following:
  • Any other person sharing your user name and password;
  • Access through a single user name and password being made available to multiple users on a network.
When you register to use the Website you will be obliged to check a check box indicating that you have read, understood and accepted these Terms and Conditions. You will not be allowed to register unless you indicate your acceptance of these Terms and Conditions and any other terms and conditions that may apply.

IP Addresses

We may log IP addresses, or the location of your computer on the Internet, for systems administration and troubleshooting purposes.

E-Mail Policy

We reserve the right to take such action as we in our sole discretion deem fit in respect of any electronic mail (E-Mail) which contains threatening, abusive, malicious, pornographic, obscene, defamatory or otherwise illegal or inappropriate material.

Unless you indicate to the contrary, all E-Mails received by us from you are deemed to have been submitted, where appropriate, for publication. If we decide to publish an E-Mail from you on the Website we will incur no liability to you by doing so. We will not disclose any personal information under any circumstances of any of the Website Administrators. Where appropriate we will endeavour to respond to E-Mails within 3 days of receipt, but give no warranty that we will respond to any E-Mail sent to us.

Compliance with Legal Process

We may disclose personal information if we are required to do so by law or we in good faith believe that such action is necessary to
(a) comply with the law or with legal process;
(b) protect and defend our rights and property;
(c) protect against misuse or unauthorised use of our web site and content; or
(d) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).

You agree that we have no control over third party content and information which can be accessed using the Website and that we do not examine or edit the use to which you or others put the Website or the nature of the content or information being accessed and that we are excluded from all liability of any kind arising from such content or information.

You agree to indemnify and hold us or our agents harmless from and against all and any expenses, losses, liabilities, damages, costs or expenses incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of, or conduct on, the Website and/or a breach of the Acceptable Use Policy and/or any of the Terms and Conditions of this Website.

We reserve the right to remove any information/material we deem to be in breach of any of these Terms and Conditions without notice, and without prejudice to any other accrued rights, and/or to make available such information/material when required to do so by law or when requested to do so by regulatory bodies or law enforcement organisations.

We provide the Website on an "as is" basis and make no representations or warranties of any kind as to the Website or the content. We make no representations or warranties about the accuracy, completeness or suitability for any purpose of the content published on the Website.

Any liability, however it occurs, for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

Data Protection

We will use any personal data collected during your use of the Website in accordance with the current Data Protection Act. When you visit our Website, we may send you a cookie. A cookie is a small file that can be placed on your computer's hard disc for record keeping purposes and we may use them to do a number of things, e.g. Cookies help us to recognise you when you next visit our Website. Specific Rules and Regulations
1. Illegal Activities Instigating, condoning, planning, suggesting or approval of illegal activities is not allowed on this Forum. Acts are considered illegal if they infringe the laws of Malta, together with all that is considered illegal under International Law. This includes slander, libel, illegal defamation and illegal threats against identifiable persons

2. General Behaviour (i) Ad hominems, insults, ridicule, and any other offensive conduct against Members, even if only in retaliation, are not permitted.

(ii) Vulgarity, bawdiness, lewdness, obscenity, profanity, discourteous conduct and any other misconduct, even if in retaliation towards other Members is not allowed

(iii) We allow fair criticism of all races; subraces; ethnicities; peoples; religious, cultural and social communities; as well as of ideologies; philosophies or any other ideas; as well as of persons and Members; attitudes; and conduct, when presented in a civil and non-insulting manner. However Ad gentum and racial slurs against any identifiable group are not permitted

3. General Rules for Posting / Replying

(i) The posting of images, videos, audio recordings, or any other information that makes them identifiable as real persons, even if previously publicly shared, of Members and Ex-Members, or of other private persons that are dedicated to European Nationalism without their consent is not permitted. The revelation of personal and private information of Members and Ex-Members, or of other private persons that are dedicated to European Nationalism, that can breach their security and safety, even if such information has previously been publicly shared, is not permitted.

(ii) Members who breach the above rule automatically free Vivamalta.net staff from all obligations of guaranteed privacy and confidentiality given to you at any time or under any circumstances. Due to the nature of this offence, Staff shall do its best to minimize such occurrences and to express solidarity with the victim and cooperate, on demand, with such Members, Ex-Members, or persons affected. This may include providing any information Staff possesses about the perpetrator, including, but not limited to names, photos, telephone numbers, residence or location, the complete posting record, E-Mail addresses, IP addresses, whether obtained from private E-Mails or otherwise.

(iii) Defamation and insults directed against Vivamalta.net and/or the Administrators and Staff, are not permitted.

(iv) Posts / replies may be either in Maltese or English.

(v) Posts without a serious message and with no information value for third parties are not welcome on the Forum. Trolling, or the posting of absurd posts with the intention to provoke reactions are not permitted.

(vi) Constant use of block letters, fonts, colors, other text attributes, and smilies is not permitted, although they may be used for occasional accentuation.

(vii) Signatures and Avatars may not be too large in dimensions. They should be aesthetically pleasing and have to comply with all other Rules. User Names/Nicks that are considered inappropriate will not be allowed.

(viii) Vivamalta.net maintains friendly relations with most other nationalist and racialist forums and websites. Defamation and insults directed against these sites and/or their Staff and/or members, are not permitted, and will be removed by the Staff. Constructive criticism may be posted in the section reserved for Senior Staff members.

4. Administration of Vivamalta.net

(i) The Administrators are the persons in charge of enforcing the rules, and shall enforce them at their own discretion. The Staff possess full editorial discretion to delete, move, edit, split, merge, change, stick, unstick, open, close or amend posts, threads, and attachments of Members for purposes of rule enforcement, categorization, and to manage their readability, accessibility, or availability. Threads, posts and attachments that violate the rules can be deleted, moved or edited by Staff without notice.

(ii) Any single Member of Senior Staff can discipline Members with moderation or bans up to one month. In exceptional cases, where abuse is conducted via private functions of the board or if there is reasonable ground to fear such future abuse, a permanent ban may be imposed.

(iii) If you have been warned, or your post or threads were moderated, and you disagree with the measure, you may post about it in a civil manner in the Complaints forum, citing reasons for your disagreement and your complaint shall be fairly considered. All such complaints that do not follow these proceedings, in particular all those that are posted in other threads shall be deleted and ignored.

(iv) The Administration is the final solicitor of the rules and their enforcement, as well as the sole authority and judge over Staff. It reserves the right to discipline Members and Staff at its own will for all reasons within and beyond the scope of Vivamalta.net.

Glossary

Ex-Member: person that is banned or whose account has been deleted.
Member: person that holds a legitimate and active account on Vivamalta.net, including a moderated account.
Staff: Moderators.
Senior Staff: Super Moderators and Administrators.

These Terms and Conditions of use, together with Privacy Policy and General and Specific Rules and Regulations and Mission Statement were drawn up by the Administrators on Monday 14th March 2005.
