Chief Justice suggests mediation while appeals are pending





 
Chief Justice Silvio Camilleri today made sweeping proposals for mediation while cases are pending appeal, special appeal hearings when sentences issued by different judges appear divergent, and a system for more cases to be set by appointment...
 
...Since the number of pending appeals had built up, there was a significant delay until cases were appointed, he noted...

Take the issue with the MEP campaign expenditure, for instance - a story she worked on for 10 solid weeks. "Most candidates had broken the law - yet nobody was held to account." Rather than action being taken, in a rare show of solidarity the parties joined forces and committed to revising a law that was embarrassing them both. "Neither the police commissioner nor the AG chose to investigate. What kind of message are we giving out?" She shrugs her shoulders...

And We are expected to respect the whole Judiciary - my foot!

Pending appeals reach 578
 
Up to the end of July this year there were 578 appeals pending before the Criminal Court of Appeal from decisions handed down by the Magistrates? Courts in Malta and Gozo.
At the same time there were also 37 pending appeals before the Criminal Appeals Court from sentences handed down by the Criminal Court.
Justice Minister Carm Mifsud Bonnici gave the information in reply to a parliamentary question by Labour MP Jos? Herrera.
Answering another PQ by Dr Herrera, Dr Mifsud Bonnici said that in 2010 the Criminal Court of Appeal had decided 14 appeals from sentences handed down by the Criminal Court, and 11 up to the end of July this year.

May we please learn more about this substantial increase in Appeals being made - for instance alot of what is deemed to be unnecessary appeals are being made by the Attorney General`s Office: some appeals are truly absurd where individuals not being found guilty by the Magistrates` Court find themselves in time-consuming and money-squandering appeals being made by the Attorney General and his staff. Do these employees of the State have nothing better to do? A formal investigation ought to be made.
 
Then in situations where the AG was legally bound to investigate the facts, such as in the MEPs Elections` false declarations by candidates who abused flagrantly Malta`s Electoral Laws [ such illegalities were publicly admitted to by the candidates themselves ] ,no action was taken. Many regard this as CORRUPTION facing YOU in the FACE!!
 
 
Let us get serious and not waste any further the People`s Money.

Election candidates say they did not overspend
Eight claim they spent nothing


All 167 candidates who contested the last general election have submitted a sworn declaration stating they did not exceed the €1,400 expense limit per district in their electoral campaigns.

An exercise conducted by Times of Malta shows many of the candidates, particularly those elected, declared expenses of just a few euros short of the legal limit. On the other hand, eight unelected candidates declared they spent nothing on their personal campaigns.

Thursday, 16th February, 2017

Proposed defamation laws are a serious threat to Internet Freedoms

The proposed nebulous law presents a perverse affront to basic online rights and the ability of citizens to use the Internet as a tool to exercise free speech.

The Malta Information Technology Law Association (MITLA)
takes note of the Bill presented by Government entitled the Media and Defamation Act, 2017 (MADA) and expresses its deep reservations regarding a number of proposed elements, especially in relation to its applicability to the Internet.
Whilst MITLA notes that a public consultation exercise is yet to occur, it must immediately voice its concerns regarding certain definitions and obligations being introduced in relation to websites.
MITLA is concerned about the newly proposed obligations for websites, as defined in MADA, to be registered in a Media Register and failure of which can carry, on conviction, the payment of a fine of up to €1,000.
It is unfortunate to note that such registration scheme is similar to a number of repressive laws introduced in totalitarian states such as China, Bangladesh and, most notably, Russia through its infamous ‘Bloggers’ Law’, by virtue of which certain websites require registration with the State; a direct curtailment to freedom of speech online. The Internet is a bastion of activity and free expression - registration will put this under Government control.
MITLA’s preoccupations are further augmented by the definition proposed in MADA for websites as “any web-based news service or other web-based service relating to news or current affairs that operates from Malta or in respect of which editorial decisions are taken in Malta”. A literal interpretation of this definition implies that any website which contains information about “news” and/or “current affairs” (both undefined terms) will require such registration (which in turn can be nullified after 3 months of inactivity). Such obligations are unprecedented in modern democratic societies.
