A migrant rescue boat with some 10-20 migrants on board is anchored outside Maltese territorial waters waiting for instructions from Italian authorities on where to disembark the migrants.

The Golfo Azzurro, which is partnered with the Boat Refuge Foundation, only stopped close to Malta because some of its crew members had bought tickets for flights departing from Malta.

An Armed Forces of Malta spokesperson said a Transport Malta launch was making its way towards the vessel to pick up the crew members who need to fly home from Malta.

There is as of yet no decision on where the migrants, who were reportedly picked up just off the Libyan coast, will be disembarked. Rescued migrants are usually taken to Sicily.

A Transport Malta vessel has been dispatched to pick up those crew members aboard the ship with tickets for flights departing from Malta


 A Boat Refugee Foundation vessel carrying up to 20 migrants has been left stranded in international waters after Italy seems to have denied it entry to its ports, citing breach of a new Code of Conduct for Search-and-Rescue NGOs introduced last week.

MaltaToday is informed that the rescue vessel Golfo Azzurro had made for Lampedusa, which was the nearest port of call, but was refused entry by the Italian authorities.

Sources said that the Maltese government is adamnant that Italy needs to take the migrants in since Lampedusa was the nearest port of call to where they were saved by the NGO. Moreover, Italy had been in contact with the vessel during the rescue.
The vessel, Golfo Azzurro, approached Maltese waters because some of its crew members were in possession of tickets for flights departing from Malta.

Deputy PM plays down incident, says international law is clear


 Malta's decision not to allow a rescue vessel to disembark migrants here was in keeping with international law, deputy prime minister Chris Fearne said this morning.
Dr Fearne insisted the closest, safest port of call was Lampedusa and not Malta.
Rescue vessel Golfo Azzurro has been circling just outside Malta's territorial waters since yesterday, awaiting instructions on where it can disembark three migrants it picked up off Libya.

According to reports, Italy has denied the ship permission to disembark the migrants in Lampedusa, claiming that a new code of conduct for NGOs involved in such activities had not been observed. 
Among other things, the code of conduct includes a demand that ships carry an armed policeman aboard.
Another point forbids ships from transferring people to other boats, a measure apparently aimed at shutting down smaller rescue ships that normally transfer migrants to larger vessels to be brought to Italy.


NGOs say the code would be a violation of international maritime law - a position echoed by  Fulvio Vassallo, a professor of international law at the University of Palermo.
"The code of conduct isn't meant to save more lives but to limit the number of people rescued by the NGOs," Prof. Vassallo told Reuters last week. "It's being sold to the public as something that will lower departures from Libya, which it will not do. Unfortunately, it could increase the number of victims."
Italy's refusal to accept migrants aboard the Golfo Azzurro could indicate a shift in its approach to migration. But Mr Fearne played down the incident.
"This is an isolated case and we must not make it out to be the rule," he said this morning.

As one can see, the Golfo Azzurro is heading towards Sicily.
Let the Italians reap the "black cargo" - and let us see whether they will impound the ship and arrest the remaining crew for aiding and abetting human trafficking.

Golfo Azzurro denied entry to Italian waters after rerouting from near Malta

A migrant rescue vessel denied entry into both Italian and Maltese territory remains stranded in international waters after rerouting towards Sicily earlier today.
The Golfo Azzurro was intercepted by an Italian coast guard ship as it approached the Sicilian port town of Pozzallo, having spent more than 24 hours circling just outside Malta's territorial waters.
Ship tracking services showed the vessel heading west of Sicily at around 5.35pm, only for it turn and face east around 40 minutes later, with an Italian coast guard vessel keeping watch close by.

The Golfo Azzurro, which is carrying three migrants aboard, was stranded in international waters following a diplomatic tug-of-war between Italian and Maltese authorities.
The ship's captain originally planned to disembark in Lampedusa but diverted towards Malta after Italian authorities denied it entry into its ports, allegedly saying Barcelona-based NGO Proactiva Open Arms, which is running the rescue operation, had failed to comply with a recently-introduced code of conduct.


Maltese authorities also declined to green light the ship's entry, insisting that international maritime law clearly stated that the ship had to be granted entry to the nearest port of call - in this case Lampedusa.

Deputy prime minister Chris Fearne reiterated this line earlier today, telling Times of Malta the government was right to deny the ship entry and that international law was clear on the matter.

Code of conduct
According to Italian news agency ANSA, Open Arms signed up to the controversial code of conduct earlier today. It is not known whether the NGO’s decision to comply with the code is related to the Golfo Azzurro’s northbound rerouting.

Among other things, the code of conduct includes a demand that ships carry an armed policeman aboard. It also forbids ships from transferring people to other boats, with the measure apparently intended as a means of shutting down smaller rescue operations, which use small vessels to rescue people distressed at sea before transferring them to larger vessels.
NGOs say the code would be a violation of international maritime law, and the code has also drawn criticism from international law experts.
 
"The code of conduct isn't meant to save more lives but to limit the number of people rescued by the NGOs," international law professor Fulvio Vassallo told Reuters last week. "It's being sold to the public as something that will lower departures from Libya, which it will not do. Unfortunately, it could increase the number of victims."

Four rescue NGOs have now signed up to the code – Proactiva Open Arms, Save the Children, Moas and Sea. SOS Mediterranee, Medicines Sans Frontiers, Sea-Watch and Jugend Retter have not.
Italian authorities seized a vessel operated by Jugend Retter last week, accusing the NGO of having made contact with people smugglers off the Libyan coast.
Italy's shift towards a more hardline stance comes as the country prepares for elections next spring and with public sentiment towards migrant arrivals increasingly sour.

An estimated 600,000 migrants have reached it by sea from North Africa since 2014, and immigration has become a key electoral issue. Populist movement Cinque Stelle, which leads in the polls, has called for an end to NGO migrant rescues, calling them a "sea-taxi service".


Warning shots
Proactiva Open Arms said on Twitter that a second boat it operates received a threatening radio call from the Libyan coastguard on Monday morning while patrolling international waters some 13 miles from the Libyan coast between Tripoli and Zuwara.
A spokesperson for the NGO told Reuters that the Libyan coastguard had fired shots into the air in the direction of the boat. The NGO also published a video of the alleged incident on Twitter.


Libya's coastguard appeared to confirm this, saying one of its patrol vessels had fired two shots into the air after finding the Spanish boat exactly 12 miles from the Libyan coast, an area he said was for Libya to patrol.
"We demanded they leave immediately and head north but they did not obey the instructions," coastguard spokesman Ayoub Qassem told Reuters.
The European Union is providing funding and training for the Libyan coastguard.

A spokesperson for Proactive OpenArms, the NGO operating the rescue vessel, has told The Malta Independent that the boat is just outside Sicily, awaiting for instructions by the Italian authorities.

On Tuesday evening, the vessel started to head North towards Pozzallo, Sicily after a diplomatic dispute between the Maltese and Italian authorities.

The ship has been stranded outside Malta's waters as Italian authorities refused to let the migrants disembark. The Maltese authorities did the same with Deputy Prime Minister Chris Fearne saying that Malta has every right to refuse the migrants.

The boat was originally headed towards Lampedusa. It was diverted to Malta after the Italians believed that the NGO involved in the rescue operation, failed to comply with the most recent code of conduct.

The Maltese government also refused to let the ship enter Maltese waters arguing that international maritime law clearly states that the ship had to disembark in the nearest port of call, which in this case means Lampedusa.

The vessel was originally believed to be operated by the Dutch NGO Boat Refugee Foundation. However it later emerged that the vessel had recently shifted ownership to Proactiva Open Arms.

Posting on Twitter, this same organisation said that a second vessel they operate received warning shots from the Libyan Coast Guard. A video of the incident was posted on their Twitter account.
